Return and exchange

Dear Ladies and Gentlemen, any customer making a purchase as a consumer (i.e. as a natural person who purchases the Goods for purposes not directly related to business or professional activity), who has concluded a distance agreement via the Online Shop www.oleksy.pl, regardless of the form of delivery or receipt of Goods, may withdraw from this agreement without giving reasons and without incurring costs (except for the costs of sending the Goods back to the Seller; additional costs related to the Consumer’s choice of the method of Goods delivery other than the cheapest method of delivery offered by the Seller, constituting the difference between the cost of delivery chosen by the Consumer and the cheapest cost offered by the Seller;

costs related to the Consumer’s liability for reduction in the value of Goods resulting from its use in a manner beyond what is necessary to determine the nature, characteristics and functioning of item), making an appropriate declaration within fourteen days from the date of taking possession of Goods being the subject of this agreement by the Consumer or a third party indicated by the Consumer, other than the carrier. Withdrawal from the agreement takes place through the submission of a declaration by the Consumer. In order to meet this deadline, it is sufficient to send the Seller, before the expiry of this deadline, an appropriate customer’s statement.

 

In case of effective withdrawal from the agreement, the agreement is considered not concluded, the Consumer is obliged to send back the purchased Goods immediately, not later than within 14 days from the day on which he withdrew from the agreement. Direct costs of sending back the Goods shall be borne by the Consumer.

Returned Goods should be sent back to the address of the Salon run by the Seller, from which the Goods have been sent or received. It is also possible to return the Goods by the Consumer personally in the Salon run by the Seller. The addresses of Salons are given on the website www.oleksy.pl

The return of payment to the Consumer will take place immediately, not later than within 14 days from the receipt of statement on withdrawal from the Agreement. However, the Seller may withhold the return of payment until the receipt of Goods back or delivery by the Consumer of proof of its return, depending on which event occurs earlier. The refund shall be made using the same method of payment as used by the Consumer, unless the Consumer clearly indicates in the statement of withdrawal another method of refund, which does not involve any costs for the Consumer.

In case the Consumer bears the costs of shipping the Goods, these costs are also subject to reimbursement. However, if the Consumer has chosen a method of Goods delivery other than the cheapest method of delivery offered by the Seller, the Seller is not obliged to reimburse the Consumer for any additional costs incurred by him.

The Consumer shall be liable for any diminished value of Goods resulting from their use beyond what is necessary to establish the nature, characteristics and functioning of goods.

The right to withdraw from the agreement concluded away from business premises or at a distance shall not apply to the consumer in respect of the agreements:

  1. for the provision of services, if the entrepreneur has performed the service in full with the express consent of the Consumer, who has been informed before the provision of services that after the entrepreneur has performed the service, he will lose the right to withdraw from the agreement,

  2. where the price or remuneration depends on fluctuations in the financial market over which the entrepreneur does not exercise control and which may occur before the expiry of withdrawal period,

  3. in which the provided service is non-prefabricated benefit, manufactured to the Consumer’s specifications or intended to meet personalized needs,

  4. in which the provided service is good that is perishable or has a short shelf life,

  5. in which the provided service is good supplied in sealed packaging which cannot be returned after opening for health reasons or for hygienic reasons if the packaging has been opened after delivery,

  6. in which the consideration relates to goods which, by their nature, will be inseparably combined with other goods after delivery,

  7. in which the provided service relates to alcoholic beverages for which the price was agreed at the time of conclusion of the sales agreement and which can be delivered only after 30 days and the value of which depends on fluctuations in the market over which the entrepreneur has no control,

  8. where the Consumer has expressly requested the entrepreneur to come to him for the purpose of carrying out urgent repair or maintenance, if the entrepreneur provides services other than those which the Consumer has requested, or the supply of goods other than the spare parts necessary for carrying out the repair or maintenance, the right of withdrawal shall apply to the Consumer in respect of additional services or goods,

  9. in respect of sound or visual recordings or computer programs supplied in sealed packaging, if the packaging has been opened after delivery,

  10. for the supply of newspapers, periodicals or magazines, with the exception of subscription agreement,

  11. concluded by public auction,

  12. for the supply of accommodation other than for residential purposes, transport of goods, car rental, catering, leisure, entertainment, sporting or cultural events, where the agreement stipulates a day or period for the supply of service,

  13. for the supply of digital content, which is not recorded on a tangible medium, if the provision of service has begun with the Consumer’s express consent before the end of withdrawal period and after the entrepreneur has informed the Consumer of the loss of withdrawal right.
